To the Honorable William Butler, judge of said court: The register in bankruptcy to whom was referred the petition of the assignees of said bankrupt's estate for a determination of their rights to certain memberships of said bankrupt in the New York ami Philadelphia Stock Exchanges claimed by the said Charles T. Yerkes, Jr., and for a sale thereof, with an order upon the said Charles T. Yerkes, Jr., not to interfere therewith, and such further order and decree as the exigencies of the case may require, and the answer of said Charles T. Yerkes, Jr., thereto, respectfully reports that on May 23d, 1884, 2 p. m., Messrs. Sparhawk and Duffield, two of said assignees, with their counsel, Ceorge Junkin, Esq., and the said diaries T. Yerkes, Jr., with his counsel, Frank P. Pritchard, Esq., appeared before the register, at which time and at subsequent times testimony was taken under the said reference and argument made and the subject finally submitted by counsel for consideration and report in February 27, 1885. The following is a statement of the material facts necessary to be considered in the determination of the questions referred: 83 Charles T. Yerkes, Jr., a banker and broker, failed in October, 1871, was duly adjudged a bankrupt, and the petitioners became assignees of his estate January 24, 1872. In the schedules of his property filed in the proceedings under the head of "Schedule B; 2, personal property; C, stock in trade in my business of banker and broker at Philadelphia," appears the following: "Membership in board of brokers, Philadelphia, of no specified value.
